What Is DOT Testing?
The U.S. Department of Transportation (DOT) requires drug and alcohol testing for safety-sensitive employees in federally regulated industries — including trucking, aviation, rail, transit, and pipeline. These rules are governed by 49 CFR Part 40 and enforced by agencies like the FMCSA, FAA, FRA, FTA, and PHMSA.

49 CFR Part 40
The DOT's procedural regulation governing how drug and alcohol tests must be conducted, who can perform them, and how results are reported and managed.
FMCSA 49 CFR Part 382
Applies to commercial motor vehicle (CMV) drivers holding a CDL. Requires pre-employment, random, post-accident, reasonable suspicion, return-to-duty, and follow-up testing.
Random Testing Pools
FMCSA requires a minimum 50% random drug testing rate and 10% random alcohol testing rate annually for covered drivers. Employers must use a scientifically valid random selection method.
SAMHSA-Certified Labs
All DOT urine specimens must be analyzed by a SAMHSA-certified laboratory. PathScreen Labs uses only SAMHSA-certified lab partners for all DOT testing.
Medical Review Officer (MRO)
A licensed physician (MRO) must review all positive, adulterated, substituted, or invalid lab results before they are reported to the employer.
Record Keeping
DOT regulations require employers to maintain testing records for 1–5 years depending on the record type. Failure to maintain proper records is a compliance violation.
Drug & Alcohol Program Requirements
A compliant DOT program includes six required test types.
Pre-Employment
Required before a CDL driver first performs safety-sensitive functions. Must receive a verified negative result before the driver can begin work.
Random Testing
Unannounced, scientifically random selection throughout the year. FMCSA minimum rates: 50% for drugs, 10% for alcohol.
Post-Accident
Required after accidents meeting specific FMCSA criteria — including fatalities, injuries, or disabling vehicle damage. Must be completed within strict time windows.
Reasonable Suspicion
When a trained supervisor observes signs of drug or alcohol use, testing is required. Supervisors must complete DOT-required training.
Return-to-Duty
Required after a driver violates DOT drug/alcohol rules. Must receive a verified negative result and complete a Substance Abuse Professional (SAP) evaluation.
Follow-Up Testing
Unannounced follow-up tests required after return-to-duty — minimum 6 tests in the first 12 months following return.
